1. Ownership of Rights

Guillermo Fernández (Gfroca) (hereinafter referred to as the “Rights Holder”) declares that he is the sole author and owner of all intellectual property rights in the musical works broadcast and made available through his official channels, including musical compositions, master recordings, and arrangements.

These works are not registered with, nor administered by, any collective rights management organization, including but not limited to SGAE, AGEDI, AIE, or similar entities.

2. Purpose of the License

Through this document, the Rights Holder expressly authorizes any business establishment, company, professional, association, event organizer, or any natural or legal person (hereinafter referred to as the “Licensee”) to publicly play the original music published on the Rights Holder’s official YouTube channels as:

  • Background music in commercial premises
  • Music for in-person events
  • Music played during live-streamed broadcasts

This authorization constitutes a public performance license granted directly by the Rights Holder.

This license exclusively authorizes public performance and background music use. It does not authorize the creation of derivative works, synchronization with edited audiovisual productions, or any use other than those expressly permitted in this document.

3. Scope of Application

This license applies exclusively to original musical broadcasts, recordings, and content published on the following official YouTube channels:

  • CantabriaOnline Música
  • GoWay Music
  • GoWay Time
  • GoWay Focus

as well as any other official channel managed by Guillermo Fernández (Gfroca) that expressly states its adherence to this license.

Any musical content owned by third parties or not belonging to the Rights Holder is expressly excluded.

4. Permitted Uses

This license allows:

  • Public playback of the music in commercial establishments
  • Use as background music, ambient music, or sound accompaniment
  • Use in bars, shops, gyms, restaurants, offices, hotels, and other publicly accessible venues
  • Use at in-person events
  • Use during live-streamed broadcasts, provided the music is played directly from YouTube
  • Use without the need to pay royalties or fees to collective rights management organizations
  • Playback on the Licensee’s websites or digital platforms, provided that the music is not the primary content and is not synchronized with edited video productions

5. Conditions of Use

The Licensee agrees to:

  • Play the music without modifying the works
  • Refrain from exploiting the music commercially beyond the public performance rights granted herein
  • Not resell, redistribute, or sublicense the music
  • Not claim ownership of the works or present them as their own
  • Use only the Rights Holder’s official broadcasts and publications
  • Always stream the music directly from YouTube without downloading any files
  • Credit the author whenever the music is used at events or during live broadcasts by including a reference to the original channel from which the work is played

6. Restrictions

This license does not authorize:

  • The creation of derivative works
  • Synchronization of the music with videos, advertisements, films, or other edited audiovisual productions
  • Downloading, copying, or distributing the original audio files
  • The creation of independent music broadcasts not originating from the Rights Holder’s official channels
  • Use of the music as the primary content of pre-recorded videos
  • Incorporation of the music into videos, podcasts, broadcasts, audiovisual productions, or third-party content, whether monetized or not, except for the expressly authorized live-streaming uses described in this license

This license does not expand, modify, or override YouTube’s Terms of Service. Any use of the content within YouTube remains subject to YouTube’s Terms of Service and to the functionalities and permissions made available by the platform at any given time.

Exception: Use during live-streamed broadcasts is permitted provided the music is played directly from YouTube without downloading, editing, or altering the content.

7. Duration

This license is granted for an indefinite period provided that:

  • The Licensee complies with the terms of this document
  • The music remains publicly available
  • The Rights Holder does not revoke or modify the license

8. No Collective Rights Management

The works covered by this license are not administered by SGAE, AGEDI, AIE, or any comparable collective rights management organization.

9. Disclaimer of Liability

The Rights Holder shall not be liable for:

  • Technical issues arising from third-party platforms
  • Unauthorized uses carried out by the Licensee
  • Misinterpretations of applicable laws or regulations by third parties

10. Acceptance

Any use of the music constitutes full acceptance of the terms and conditions of this license.
